Brad Simpson in court Tuesday as his team tries to get his murder indictment thrown out

SAN ANTONIO — Brad Simpson was in court Tuesday as his lawyers tried to get his murder indictment thrown out.

Simpson is accused of killing his wife Suzanne and then hiding her body. The Olmos Park mother been missing for six months as Simpson remains in custody in the Bexar County Jail.

Simpson’s defense team filed a motion to quash his murder indictment. The evidence in the indictment includes allegations that Simpson tried to hide a motorized saw with Suzanne’s DNA on it. 

The motion was an attempt to question the prosecution’s evidence, including the fact that her body was never found.

The defense prepared a presentation to argue their case to quash the murder indictment that accuses Simpson of causing serious bodily injury to Suzanne. The indictment says the cause and manner of her death is unknown to the grand jury and the defense argued they cannot build a defense to something that is unknown.

The prosecution argued they are not required to prove how Brad Simpson allegedly murdered his wife, only that he had intent to commit the crime. 

After hearing both sides, the judge is giving the state a week to come up with a response for one of the counts of the motion. The judge’s ruling is set for April 29 at 9 a.m.

A trial date for the murder charge has not yet been set.
