The Bexar County D.A. shared it would be hard to prove Reyes is a suspect in the case.
SAN ANTONIO — Charges are now dismissed in the capital murder trial of Juan Reyes that was supposed to start this week.
Reyes was accused of shooting and killing Sergio Soto and Rachel Martinez on July 7, 2022, then setting their home on fire.
The Bexar County District Attorney’s office shared they were going to have a hard time proving Reyes is a suspect in this case.
One of the state witnesses recently made statements that cast doubt on their testimony.
Without this witness, the state can’t prove beyond a reasonable doubt that Reyes is tied to the case.
For background, Juan Reyes was arrested back in July of 2022 for allegedly killing Sergio Soto and Rachel Martinez at their home on Waverly, then setting it on fire.
In the arrest affidavit, police say Reyes’ mother dropped him and a friend off at Soto’s house, but Soto told them to leave because they had been drinking.
When Reyes and his friend came back from a fast food spot, police say they returned to Soto’s house with an additional person.
That’s when police say they gathered video evidence of Reyes and two others going into the home to hear three gunshots when they were inside.
The arrest document says Soto and Martinez were shot in the head and police suspected the fire was supposed to cover it up.
The arrest affidavit also says at least three family members, including Reyes’ mom identified him as the person walking away from a burning home where two people had been shot.
The Bexar County District Attorney’s Office gave KENS 5 a statement saying they knew the case was going to be difficult to prove, but were prepared to take it to trial.
