A Maryland man who repeatedly came to Texas to abuse a 13-year-old blamed a “witch” and a hacked phone, but jurors still sent him away for 75 years.

MONTGOMERY COUNTY, Texas — A man who repeatedly traveled from Maryland to Montgomery County to sexually abuse a 13-year-old child has been sentenced to a 75-year, day-for-day prison term after a jury rejected his claim that a “witch” in Mexico compelled his actions and hacked his phone.

Cross-country trips to abuse child

Prosecutors said 43-year-old Walter Hernandez-Martinez began traveling from Maryland to Montgomery County in 2023, making multiple trips that culminated in two documented assaults in February and May 2024 inside a residence where a younger child slept nearby. Evidence at trial showed that during these visits he sexually abused the 13-year-old and used his phone to solicit nude images, send sexually explicit videos of himself, and discuss plans for sexual activity with the child.

Digital trail and emergency contraception

Investigators recovered communications from Hernandez-Martinez’s phone showing that he purchased emergency contraception and other contraceptives and directed the child to take them after the abuse. Digital forensic analysts with the Montgomery County District Attorney’s Office also pulled search history related to emergency contraception, pornographic material involving seemingly juvenile individuals, and stored videos, along with GPS data placing him in the Conroe area during the offense dates.

Abuse discovered and forensic proof

The May 2024 assault came to light when an adult walked into the room and found Hernandez-Martinez and the child undressed, prompting the child’s immediate transport for a forensic medical exam. That examination documented injuries consistent with sexual abuse, and DNA testing confirmed Hernandez-Martinez’s involvement.

Claims of witchcraft rejected

Taking the stand in his own defense, Hernandez-Martinez admitted to one instance of sexual abuse but denied the second allegation, offering an explanation to jurors. He claimed a “witch” in Mexico compelled him to commit the offense and had hacked his phone to send messages and conduct the incriminating searches, an account the jury rejected and instead found him guilty of continuous sexual abuse of a child under 14.

No-parole 75-year sentence

On Dec. 10, a Montgomery County jury convicted Hernandez-Martinez, and Judge Patty Maginnis of the 435th District Court sentenced him to 75 years in the Texas Department of Criminal Justice, a day-for-day sentence with no possibility of parole under Texas law.

Assistant District Attorney Criss Cole said Hernandez-Martinez “crossed the country to abuse a vulnerable child and thought distance would protect him,” while District Attorney Michael Holley added that the day-for-day sentence ensures Hernandez-Martinez “will never again have access to a child.”
