Former SAPD officer accused of shooting teen in McDonald’s parking lot is back in court

Erik Cantu was seriously wounded when former SAPD Officer James Brennand shot him on Oct. 2, 2022.

SAN ANTONIO — A former San Antonio Police officer accused of shooting Erik Cantu was back in court on Thursday.

James Brennand is charged with aggravated assault as a public servant in the 17-year-old’s shooting in a McDonald’s parking lot back in October of 2022.

The judge ruled in favor of the state on Thursday. They want the city to hand over files on 59 SAPD officers they say are tied to the case. This is going to delay the case going to trial another three to four months.

James Brennand was present at Thursday’s hearing, which lasted about an hour with pushback from the city saying this would be a burdensome task to complete for information they consider frivolous.

The state says they made this subpoena so they and the defense can have all available information in this case when calling expert witnesses to prevent a mistrial.

The defense agreed with the state’s subpoena saying it will help them know what can be said in court so they can be prepared.

Judge Joel Perez says a review will be done on the files so both sides can have the essential information to help them build their cases.

Brennand was fired within days of the Oct. 2, 2022, shooting, and indicted just two months later. Cantu was in the hospital for seven weeks after the incident.
