
Noe Guerrero-Mendieta was out on bond when ICE agents arrested him because they said he was not carrying the proper immigration documents.
WACO, Texas — U.S. Immigration and Customs Enforcement arrested a man in Waco who authorities said was in immigration proceedings and out of custody on bond.
According to a criminal complaint filed in U.S. District Court for the Western District of Texas, Noe Fermin Guerrero-Mendieta is a citizen of Mexico and is required to carry a certificate of alien registration receipt card.
When Guerrero was arrested on July 24, the complaint states he did not have the documents.
A video posted to social media shows members of the ICE Waco Fugitive Operations team speaking with Guerrero in Spanish while he’s sitting in his vehicle. About two minutes into the video, one of the ICE officers smashes the driver side window to open the door. Guerrero gets out of the vehicle without further incident.
Guerrero’s failure to carry the documents violates Title 8, U.S. Code Sections 1302(a) and 1304(e) which mandate that registered aliens keep immigration paperwork with them while in the country, according to the complaint.
The arrest and charges were confirmed by Supervisory Detention and Deportation Officer Mark S. Carlino, who signed the complaint. Guerrero appeared before U.S. Magistrate Judge Derek T. Gilliland on the day of his arrest.
