LIVE OAK, Texas — A 41-year-old man has been accused of having sexual intercourse several times with a 16-year-old girl he met on Tinder, court records say.
On Dec. 2, 2025, the teen made an outcry saying that a man named James David Surre had sexually assaulted her.
Eventually, SAPD found out that several sexual assault incidents happened in Surre’s Live Oak home between Surre and the teen.
The teen told officials that her and Surre had met on the dating app “Tinder.” She, 16, had indicated she was 18 on the app, according to the affidavit.
While chatting on the app, the victim and Surre had planned for him to pick her up from school on Oct. 17, 2025. On that day, Surre picked the girl up and drove her to his house located in the 7800 block of Forest Path, the affidavit says.
During the drive, the teen allegedly told Surre that she lied about her age and that she was actually 16 years old, unlike what her profile said.
Despite this, the affidavit says Surre ignored this fact and continued to drive to his house. Once there, the two allegedly engaged in consensual sex.
Investigators then discovered that the two had engaged in more sexual encounters that had been recorded on the girl’s cell phone. Surre had asked her on some occasions to send him copies of the footage, which the girl did.
The girl said her and Surre had sex six times, all starting with him picking her up from school. She said on one of those occasions in late October her choked, hit and dragged her about her hair. At one point she said he forced himself upon her.
She said that the penetration caused her pain.
Detectives retrieved videos of the intercourse from the girl’s phone, confirming to them that Surre was the one having sex with her. There were 10 separate videos retrieved.
On Feb. 18, Surre was arrested for aggravated assault of a child. He posted $100,000 bond two days later, court records show.
During the arrest, a search warrant was also obtained to seize Surre’s cellular devices.
After data extraction, numerous photos and videos of the victim and Surre were found as well as “depicting the intimate areas of the victim and an unknown child.”
These graphic videos and photos allegedly showed Surre performing oral sex on the unknown child, according to the documents.
A second search warrant was obtained to seize the child porn images, videos, chats and emails found.
On March 6, 27 sexually explicit videos of the victim were found, the affidavit says. One video of the unknown girl was also found.
In the image section, officials allegedly found 104 sexually explicit images of the victim, some of them being screenshots from the various videos filmed.
In total, 131 images/videos were allegedly found on Surre’s phone.
Due to this, Surre was also charged with possession of child pornography, more than 50 visual depictions.
As of Wednesday, Surre remains in the Bexar County jail with a $175,000 bond.
