AUSTIN, Texas — A man who police say admitted to stabbing another man on a CapMetro bus in May has been deemed incompetent to stand trial, according to online court records.

Deepak Kandel was charged with first-degree murder, after police say he admitted to stabbing 30-year-old Akshay Gupta because he resembled his uncle.

According to the Austin Police Department (APD), officers responded to a call in the 500 block of South Lamar Blvd., near Barton Springs Road at around 6:45 p.m. on May 14.

When police arrived on scene, they located the victim, identified as Gupta, with trauma to his body. Life-saving measures were conducted but he was pronounced dead at 7:30 p.m.

During the investigation, detectives learned that the suspect, identified as Kandel, stabbed Gupta in the neck without being provoked. Once the bus stopped, Kandel exited the bus with other passengers and left the scene on foot.

Shortly thereafter, police found and detained Kandel, who police say then admitted to stabbing Gupta.

Kandel was then booked into the Travis County Jail. It is currently unclear where the case will go from here given the new ruling.
