Mother arrested at courthouse over outburst as son’s hearing proceeds

A mother was arrested at juvenile court for an outstanding warrant linked to a prior disturbance at her son’s hearing.

SAN ANTONIO — A mother who caused a disturbance that was caught on camera the last time she came to juvenile court for her child’s detention hearing didn’t even make it inside the courthouse building Thursday morning.

The woman was arrested in connection with an outstanding warrant related to the October 13 outburst and taken to jail.

To protect the identity of her juvenile son, KENS 5 is not naming either person.

The arrest affidavit outlining the evidence related to a charge of “hindering proceedings by disorderly conduct” details what happened when the 35-year-old woman was in the 386th District Court for a regular detention hearing involving her son.

The teen, who turned 15 recently, is in custody on a charge of aggravated assault with a deadly weapon, according to a court official.

The affidavit claims that during the proceeding, both mother and son were reminded several times of a standing court rule that prohibits communication between family members and detained juveniles.

When admonished to follow the rules, the affidavit claims the woman told the deputy “He’s my son, and I have a constitutional right to speak to him,” and continued speaking with the teen.

A video recording of the incident shows the teen becoming combative with deputies while they tried to remove him from the courtroom.

As deputies took the teen to a secure holding area, the woman can be heard yelling “You’re a public servant. You work for me. My tax money pays your checks!” according to the affidavit.

The affidavit goes on to state “Due to the escalating disturbance Judge Valdes left the bench and retreated to chambers until order was restored.”

The video recording also shows that the woman continued to yell until deputies escorted her from the courtroom, down the hall and out of the building.

The affidavit states the woman was advised she would not be permitted to reenter the courthouse and she departed.

Deputies were able to obtain an arrest warrant on Wednesday, and they served it on the woman when she showed up Thursday for her son’s detention hearing.

She was surrounded in the foyer of the building before she was allowed to pass through the secure lobby.

While she was being led away, she addressed the KENS 5 camera, saying “Don’t post this. It’s inflammatory rhetoric- misinformation – KENS 5.”

The woman was taken to jail where she appeared before a magistrate judge who assigned a bond amount of $2,000, which she was able to post in a matter of hours.

The Bexar County criminal justice portal indicates the woman asked for and was granted a court appointed attorney.

Although dates often change, she is scheduled for an arraignment hearing November 24.

Just after the mother’s arrest, the son’s detention hearing took place with no parent present.

A probation officer told judge Cruz Shaw it is the teen’s first referral to the department.

Both probation and the prosecutor recommended that the teen be detained.

The defense attorney told the judge “At this time unfortunately there is no one to release him to now. His stepdad is here but he is not a legal guardian, and I know Mom’s situation is what it is right now. She should be out soon. Perhaps we could bring him back sooner for another detention hearing.”

Shaw replied that he could not release the teen because of ongoing discipline issues.

The judge ordered the teen detained until his next hearing November 6.
