
In April, a 14-year-old was attacked by a group on his way home from school when one of them pulled out a gun and fatally shot him. Now, a suspect is in custody.
SAN ANTONIO — A suspect has been arrested almost four months to the day that a 14-year-old was shot and killed after police said a group of students got into a fight while walking home when class let out for the day at the Brewer Academy.
On Thursday, 18-year-old Fernando Flores was arrested and is facing a charge of capital murder of a person.
On the afternoon of April 16, SAPD responded to the intersection of South Elmendorf and Merida Street after receiving reports of a shooting.
Records show that surveillance footage revealed a group of five students walking home from Brewer Academy got into an altercation and teamed up on another student, later identified as Simon Julian Cuevas III, after following him as he left school.
At some point during the fight, the arrest warrant states one of the students pulled out a handgun and shot Cuevas while he was on the ground..
Upon arrival, SAPD said Cuevas was found dead on the scene.
In May, Crime Stoppers released images and video of two possible suspects in the case as they were believed to have been at the scene when the crime occurred.
During the investigation, SAISD police pulled surveillance video from Brewer Academy, where both Cuevas and Flores attended.
The footage showed Flores’ mother arriving at the school when he goes to the car and retrieves an item. The video also showed several of the other suspects seen in the altercation, that eventually led to Cuevas’ death, getting out of Flores’ mothers car.
A school bus camera captured the license plate number on the car, which led to the vehicle being found and the driver being interviewed by investigators.
The investigation showed the driver had picked up three of the students from the SAPD property room and also provided the house where she picked up another two students.
Two of the other students were later identified as Flores’ brothers, according to the warrant.
Records state that each of the suspects involved in the altercation were seen getting into the same vehicle after the fight occurred, along with the fact that all five of them allegedly “worked together and planned the assault… which ultimately led to the shooting death of the 14-year-old victim.”
