BUFFALO, N.Y. — There’s an update on the legal case involving Albert the Alligator.
According to court documents obtained by 2 On Your Side, New York State must process Tony Cavallaro’s renewal application for a Dangerous Animal License within 30 days.
This decision comes after the court found that the state made an error in denying his original application.
Albert, who weighs 750 pounds, was taken by DEC officers back in March, and the fight to get him back intrigued people in Western New York and nationwide. Albert is currently at a sanctuary in Beaumont, Texas, and will have to stay there until the state processes the new application.
The State Attorney General’s Office explained why Albert was taken from Cavallero.
“He understood that he did not have and must obtain a dangerous animal license as the department had told him in January of 2021, and reminded him again in their emails in September of 2021,” the state said.
The state also argued that Cavallero did not fill out the application for this license properly.
Cavallaro’s lawyers countered by saying that could be remedied.
If the state doesn’t meet the deadline, the license will be automatically approved.
