SAN ANTONIO — Days after an explosion rocked his home and seriously injured him, a man is suing CPS and the city of San Antonio.
The explosion happened around 9:45 p.m. Saturday night on Laurel Bend on the far west side, documents say.
Fabian Garcia-Wells was severely injured and had to be airlifted to BAMC.
Garcia-Wells is now suing CPS Energy and the city for more than $1 million.
The lawsuit alleges the explosion was caused by a natural gas leak, and that it was a direct result of CPS’ failure to maintain and inspect their service and its components.
While Garcia-Wells believes the blame mostly goes to CPS, in previous lawsuits related to natural gas explosions and injuries, CPS Energy has blamed the city, claiming they weren’t able to investigate the scene and preserve evidence.
That argument was made in another lawsuit KENS 5 reported on in February, from a home explosion four years ago on the east side, which ended in a $109 million payout from CPS Energy.
In fact, the same attorney from that lawsuit is representing Garcia-Wells in this case.
KENS 5 has reached out to CPS Energy about this. They said in a statement:
“The safety of our customers and our employees is a top priority for CPS Energy. If any customer thinks they smell gas in their homes, they should leave the house immediately and call CPS Energy at 210-353-HELP(4357) or, for emergencies, call 911. Customers in the immediate vicinity of this incident were evacuated for their safety, and CPS Energy is providing housing for them until they can safely return home.”
