San Antonio woman in custody after newborn hospitalized in critical condition

SAN ANTONIO — The San Antonio Police Department said a woman is in custody after an incident involving a newborn baby that was hospitalized last week.

Police said 28-year-old Ava Marie Guerra was arrested Monday on a charge of injury to a child and reckless serious bodily injury.

According to police, officers were dispatched to the 400 block of East Commerce Street on Tuesday, January 21 where a male claimed he found a newborn baby on a sidewalk along Nolan and Cherry Street.

The baby was admitted to PICU at a local hospital in critical condition.

The man was interviewed by detectives and he later confessed that he knew where the baby was born and who the mother was. Detectives relocated to the apartment where the baby was born and interviewed the mother and witnesses.

The investigation determined that after giving birth, the woman failed to care for the child and the male took the infant from the apartment in search of medical care.

Police said SVU detectives obtained an arrest warrant for the woman and she was taken into custody.

SAPD wants to remind anyone who feels they are unable to care for a newborn, they can bring the newborn to a designated safe place with no questions asked. For more information on the Baby Moses Law, visit the website here.
