Documents say the images that investigators found on Burris’ devices depicted children who were under 15 and 12 years old.
HENDERSON COUNTY, Texas — An East Texas police officer is facing multiple charges for accusations of downloading child porn while on duty.
Cody Mitchell Burris, 32, of Tyler, has been charged with five counts of possession or promotion of child pornography.
During an investigation, Burris was identified as the person accused of downloading and sharing child porn. Investigators determined he was a Eustace Police Department officer as well.
The Henderson County Crimes Against Children’s Task Force determined Burris got some of these images while on duty through an online app. Investigators spoke with Burris while he was at the police department this past Saturday and they seized his cell phone.
According to an arrest affidavit, the images that investigators found on Burris’ devices depicted children who were under 15 and 12 years old. Several videos showed young children and infants as well.


The investigation led deputies to learn that some images were downloaded using internet services at the Eustace Police Department. Deputies determined the suspect was a police officer and the Eustace mayor identified Burris.
Devices from Burris’ house in Tyler were also taken by investigators to be analyzed. He was initially booked into the Henderson County Jail on Saturday on one count of child porn. Then, on Tuesday, four more arrest warrants were issued for possession of child pornography, according to the Henderson County Sheriff’s Office.
The affidavit states Burris had photos of child porn and two videos. Investigators say he also promoted two videos by sending them to another person.
He will be arraigned on the new charges on Wednesday, Sheriff Botie Hillhouse said.
The Henderson County Crimes Against Children Task Force investigated the case with assistance from the city of Eustace, the Henderson County District Attorney’s Office and the Texas Rangers.
