Suspect accused of throwing 81-year-old man down North Star Mall escalator is in custody, SAPD says

SAN ANTONIO – A 31-year-old man accused of pulling another man more than twice his age down a North Star Mall escalator has been arrested.

San Antonio police said Daymein Garcia was taken into custody Monday in Travis County.

The Jan. 27 mall confrontation between a female and the man began at a Dillard’s dressing room, San Antonio Police Department Detective Rodney Franklin told KSAT on Feb. 15.

The man, who wanted to try on a sweater, opened a dressing room door not knowing the female was inside. The man quickly closed the door, the detective said.

“They yelled that it was a female changing room. He yelled back, ‘No, it’s a handicapped-changing room,’” Franklin said on Feb. 15.

The 81-year-old man verified that the changing room was for handicapped shoppers, but he then went to use an unoccupied room, police said.

Garcia, who SAPD believes to be the female’s father, found the 81-year-old man going up an escalator at the mall. When the suspect found the man, he pulled him from behind, causing the man to fall backward.

The escalator incident was captured on mall surveillance video.

San Antonio police initially said it was looking for two suspects in connection with the case. It is unclear if Garcia is the only suspect the department pursued or if officers are still looking for a second suspect.

Garcia has been charged with serious bodily injury to the elderly. He is currently awaiting extradition to Bexar County, police said Wednesday.
