AFFIDAVIT: Patrick Mahomes Sr. had open beer can in vehicle, registration expired since Sept. 2022 when arrested for DWI 3rd or more

TYLER, Texas — A week before the Super Bowl, Patrick Mahomes Sr. is behind bars for driving while intoxicated 3rd or more — a third degree felony.

According to Smith County judicial records, Mahomes was taken into custody by Tyler police Saturday night. Bond was set at $10,000. He was released Sunday afternoon. According to  the state, a third degree felony is punishable by two to 10 years in prison.

Police say Mahomes was stopped around 8:30 p.m. in the 1100 block of W. Gentry Pkwy. The officer who pulled him over said there was evidence obtained during the stop that led to his arrest for DWI.

According to the arrest affidavit, when Mahomes was stopped, the officer spotted an open 16 oz. beer can in the console. Mahomes also admitted to having “a few beers” at a bar, the affidavit states. When a field sobriety test was performed, the arresting officer says they noticed evidence of intoxication. The registration on his vehicle had also been expired since September 2022.
